Party Walls

If you are proposing to undertake work at the boundary of your site, directly to a party wall or party fence wall or are planning to undertake deep excavation or piling within 3m or 6m of a neighbouring property, you will need to follow the statutory notification process of the Party Wall etc. Act 1996.

To assist you in the impartial role of Party Wall Surveyor, we will find all the relevant neighbours’ contact details, notify them, deal with their replies and, if they appoint their own party wall surveyor, we will negotiate and agree a legal document known as a Party Wall Award with that surveyor. The Award will be served on both sets of owners and will include details of the parties involved, the notifiable work under the Act, rules and restrictions surrounding the work, a schedule of condition of the adjoining property and all relevant drawings.

Our fee structure for Party Wall work is normally charged on a time charged basis based on the number of Adjoining Owners and predicted time expenditure.

Boundaries

Occasionally, and usually in suburban locations, neighbours will dispute the position of the boundary between their premises which can lead to unnecessary dispute and legal costs. We can help one or both sides by providing an independent opinion on the probable location of the boundary given the evidence of structures on site, current and historic boundary documentation and provide a report in connection. We have found this successful in mitigating unnecessary cost to either side over a matter that can be as little as a few millimetres.

If you require this service, our fee structure for boundary dispute work is normally charged on a time charged or lump sum basis based on the predicted time expenditure.

Scaffold and Access Licences

Sometimes building work needs undertaking to a property that cannot be safely undertaken from the building owner’s land and, to undertake it, would require scaffold or a crane or mechanical hoist being erected on or over a neighbour’s land.

Neighbours have no obligation or interest in providing such access which is not of benefit to them. So, our clients sometimes ask us to negotiate access to work on or over the neighbour’s land in a way that is mutually convenient to both parties. Fees for access, the fee basis for a scaffold/ crane oversail or mechanical hoist, can all be agreed along with other restrictions and conditions surrounding the permission for access. These can be detailed in a Scaffold and Access Licence or a Crane Licence, both of which we prepare and agree with a surveyor appointed for the neighbouring party.

If you require this service, our fee structure for Access Licence work is normally charged on a time charged or lump sum basis based on the predicted time expenditure.
