Building Work Disputes

Building work disputes usually arise when a client engages with the services of a contractor without a surveyor, architect or engineer to specify or oversee the work and the project gets into difficulty. Normally due to client dissatisfaction of the work undertaken, failure to agree costs in connection with amendments to the work, unrealistic expectations on the other party, or over money issues, leading the parties to dispute, often when the works are incomplete.

If you are a client or a contractor and find yourself in this situation, we can help you. We ask the instructing party to send us all available design/specification documentation, builder quotes or estimates, all contract documents and correspondence relating to variations to the work for us to study. We then undertake a detailed survey of the work undertaken and prepare a report with our advice on how to proceed further.

Usually, an independent surveyor’s report is sufficient to enable agreement between the parties, but in some cases our reports have to be produced as a Civil Procedure Rule compliant Expert Report for court or tribunal submission.

If you require this service, our fee structrure for building dispute work is normally charged on a time charged or lump sum basis based on the predicted time expenditure.

Expert Witness

Whether instructed by a solicitor acting for a client or for a court or tribunal directly, our highly experienced Chartered Building Surveyors are frequently appointed to act as Expert Witnesses to a building work related dispute between parties where the matter has become litigious.

As with building work disputes, we ask the instructing party to send us all available documents about the matter in dispute for us to study and then we undertake a detailed survey of the affected property and prepare a detailed Civil Procedure Rule compliant Expert Report answering specific questions from the appointing client team, providing independent professional opinion for court or tribunal submission. This may result in our attendance at court or a tribunal to answer questions about our expert evidence submitted.

If you require this service, our fee structure for Expert Witness work is normally charged on a time charged or lump sum basis based on the predicted time expenditure.
